There are two kinds of patent in Brazil. Each one of them has specific characteristics about the protection and validity. Check out:
It is related to new and original products or processes that are not the result of an improving process or product already in use. The chemical compositions, the industrial processes, the food mixtures and the equipment are examples of it.
Expire date: 20 years from the deposit.
Obs.: It is insured to the request-holder or the inventions patent the possibility to require a Certificate of Addition to protect improvement or a development on the invention as long as it keeps the same inventive concept even if there is no inventive activity. The Certificate of Addition is linked to the original patent with the same expire date.
It refers to improvements on products or pre-existent processes for a better utilization or to facilitate the productive process. They are improvements on furnitures, utensils, tools, etc.
Expire date: 15 years from the deposit.
There is also the protection for visual aspects of a product, known as:
It has the purpose to protect the design with the possibility to include in only one registration until 19 variations to protect, for example, a whole line of products that use the same visual identity with the same lines or decorative model.
Expire date: 10 years that might be prorogued for 3 periods of 5 years on a total of 25 years.
Important: It is not possible to register as Industrial Draw elements with a form determined by the functionality like: mortises, bindings, profiles, reinforcements, etc.
